Windfall Elimination Provisions (Social Security)

The “Windfall Elimination Provision” doesn’t apply to survivor’s benefits. "We may reduce spouses, widows, or widowers benefits because of another law. With detailed provision under the Social Security Administration Publication Number 05—10007 calls for reduction in benefits based on the surviving Spouse’s employment status."

This should never be the case! If a Spouse passed away and was entitled to Social Security benefits to be passed on to the surviving Spouse, the surviving spouse should receive those benefits regardless of their own employment status e.g., state, or federal employee.

I will propose legislation that will eliminate all penalizing provisions that stipulates reduction in spousal survivor benefits based on personal employment status.
